These Terms and Conditions explain the terms under which we provide access to our website, information, breastfeeding preparation classes, consultations, support sessions, home visits, gift cards and other related services.

Exeter Breastfeeding Service is committed to providing compassionate, professional and individualised breastfeeding education and support to expectant parents, mothers and families throughout Exeter and surrounding areas of Devon.

Our services are intended to help parents access appropriate information, build confidence, understand breastfeeding and infant feeding, and receive practical support during pregnancy and following childbirth.

By making a booking, purchasing a service or using our website, you agree to the terms applicable to that activity, subject to your statutory rights.

We encourage all customers to read these Terms and Conditions carefully before making a booking.

If you have any questions about our services or booking arrangements, please contact us before proceeding.

Nothing in these Terms and Conditions is intended to exclude, restrict or otherwise affect rights that cannot lawfully be excluded under United Kingdom legislation.

3. SERVICES WE PROVIDE

Exeter Breastfeeding Service offers a range of breastfeeding-related services intended to support parents and families.

Depending on availability, these may include:

3.1 Breastfeeding Preparation Classes

Educational classes designed to help expectant parents prepare for breastfeeding and understand common aspects of infant feeding.

Topics may include breastfeeding positioning, attachment, feeding expectations, expressing milk, colostrum and practical preparation.

Course content may vary according to the programme offered and the needs of participants.

3.2 Breastfeeding Support Drop-In Sessions

Support sessions where parents may discuss breastfeeding concerns, ask questions and receive appropriate guidance.

These sessions may operate according to advertised dates, times and availability.

3.3 Telephone Consultations

Telephone appointments providing breastfeeding information, discussion, guidance and appropriate signposting.

Telephone consultations have limitations because direct physical assessment is not possible.

Where a concern requires examination or urgent clinical assessment, customers may be advised to contact an appropriate healthcare professional or service.

3.4 Home Visits

Where offered, home visits allow breastfeeding-related concerns to be discussed and assessed in the customer's home environment.

Appointments are subject to geographical coverage, practitioner availability and any relevant access or safety considerations.

3.5 Help, Support and Signposting

We may provide information about other relevant healthcare professionals, support organisations or services where further assistance may be appropriate.

Signposting does not necessarily constitute an endorsement of a particular third-party provider.

3.6 Additional Services

We may introduce, amend or withdraw services from time to time.

The relevant description, price and booking conditions will be made available before a customer commits to purchasing a service.

4. WEBSITE INFORMATION

We aim to ensure that information published on our website is accurate, accessible and reasonably up to date.

However, information may occasionally require amendment because of changes in service availability, professional guidance, prices, dates or operational circumstances.

We may update website descriptions, appointment availability and other general information when necessary.

Information published on our website is intended primarily for education and general guidance unless it forms part of an agreed individual consultation.

We make reasonable efforts to maintain accurate content but cannot guarantee that all general website information will apply to every individual circumstance.

Customers should seek appropriately qualified medical advice where they have concerns about their own health or the health of their baby.

5. BOOKING A SERVICE

Bookings may be made through our website or another booking method made available by Exeter Breastfeeding Service.

Customers are responsible for providing accurate information when arranging an appointment, consultation or class.

Depending on the service, this may include contact details, the selected appointment, relevant background information and other details reasonably required to administer the booking.

A booking is considered confirmed when it has been accepted through the relevant booking arrangements and any applicable payment requirements have been satisfied.

An automated acknowledgement of a booking request does not necessarily constitute confirmation if additional approval is required.

Where an appointment is unavailable, we will aim to inform the customer and discuss appropriate alternatives.

We reserve the right to decline or rearrange a booking where there is a legitimate reason, including insufficient availability, service suitability, safety concerns or circumstances outside our reasonable control.

Such decisions will be made fairly and in accordance with applicable law.

6. CUSTOMER RESPONSIBILITIES

Customers are expected to provide accurate and relevant information when booking or attending our services.

Where appropriate, this may include details of breastfeeding concerns, relevant medical history, difficulties with feeding or other information necessary to understand the support requested.

Customers should inform us if relevant circumstances change before an appointment.

Customers are also responsible for attending booked sessions on time and informing us as soon as reasonably possible if they are unable to attend.

We ask customers to communicate respectfully with the practitioner and other participants.

For group sessions, customers should respect the privacy, confidentiality and comfort of others attending.

Customers remain responsible for decisions concerning their own health and their baby's care, supported by advice from appropriate healthcare professionals.

7. PRICES AND PAYMENT

The price of each paid service will be displayed during the booking process or otherwise communicated before the customer agrees to proceed.

Prices are normally displayed in pounds sterling (GBP).

Where applicable, any additional costs, such as travel charges, will be communicated before the booking is confirmed.

Payment arrangements may vary depending on the service selected.

Payments may be processed through the facilities available on our website or another agreed payment method.

We reserve the right to amend our prices for future bookings.

Changes to advertised prices will not retrospectively alter the agreed price of a confirmed booking unless the customer agrees to the change or the law otherwise permits it.

Where payment is required before an appointment, failure to complete payment may prevent confirmation of the booking.

Customers should contact us if they believe an incorrect amount has been charged.

8. CANCELLATIONS BY CUSTOMERS

We understand that circumstances can change, particularly during pregnancy and following the birth of a baby.

If you need to cancel a booking, please contact Exeter Breastfeeding Service as soon as reasonably possible.

Our published Refund Policy currently identifies arrangements for antenatal courses, consultations and breastfeeding preparation classes.

Subject to applicable consumer rights, the following arrangements are intended to reflect those published provisions.

8.1 Cancellations Following Baby Loss

We recognise that baby loss is an exceptionally difficult and sensitive experience.

Where a customer experiences baby loss, they may cancel their booking at any time and receive a full refund in accordance with our published Refund Policy.

Customers should contact us using the details provided in this document.

We will aim to handle such requests with compassion, sensitivity and discretion.

8.2 Other Cancellations

Our existing Refund Policy states that a cancellation made within 24 hours before the relevant course, consultation or class begins is eligible for a 50% refund.

Any refund entitlement for cancellations made earlier than 24 hours before the service begins will be determined by the applicable booking conditions, our published Refund Policy and relevant consumer protection legislation.

Customers are encouraged to provide as much notice as possible.

8.3 Statutory Cancellation Rights

Customers may have additional statutory cancellation rights depending on the nature of the service, how the booking was made and the applicable legal requirements.

Nothing in this section removes or reduces those rights.

Where our Refund Policy and the law provide different levels of protection, the applicable law takes precedence.

9. CONSUMER CANCELLATION RIGHTS

Certain contracts entered into online, by telephone or away from business premises may be subject to statutory cancellation rights.

Where the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply, customers may have a 14-day cancellation period.

However, the application of these Regulations depends on the nature of the contract, and certain contracts, including qualifying healthcare services and particular other categories, may be excluded from some of their provisions.

Where a statutory cancellation period applies and the customer expressly requests that a service begin during that period, additional rules may govern payment for services already provided.

Where legally applicable, the right to cancel may be lost once a service has been fully performed, provided the necessary conditions have been satisfied.

We will not assume that every healthcare-related service is subject to identical cancellation rules.

We will provide applicable cancellation information before the customer becomes contractually bound, as required by law.

These Terms and Conditions must not be interpreted as excluding rights or remedies provided by the Consumer Rights Act 2015 or other applicable consumer legislation.

10. REFUNDS

Refunds will be considered in accordance with our published Refund Policy, the terms applicable to the booking and any statutory rights.

Where a full or partial refund is due, we will arrange repayment using an appropriate payment method.

Refunds will be processed within the period required by applicable law.

Where no specific statutory period applies, we aim to process approved refunds within a reasonable timeframe.

The time taken for refunded funds to appear in a bank or card account may depend on the payment provider.

A customer who believes a refund has been calculated incorrectly may contact us for clarification.

The availability of a contractual refund does not limit the customer's separate rights where a service has not been provided with reasonable care and skill or where another statutory remedy applies.

11. RESCHEDULING APPOINTMENTS

Where reasonably possible, customers may request that an existing booking be moved to another available date or time.

Requests should be made as early as possible.

Rescheduling is subject to the availability of suitable appointments or classes and any conditions communicated at the point of booking.

We cannot guarantee that an alternative date or time will always be available.

Where a proposed change cannot be accommodated, the applicable cancellation and refund arrangements will apply.

Any additional charge for rescheduling must be reasonable, lawful and communicated before the customer agrees to it.

12. CANCELLATIONS OR CHANGES BY EXETER BREASTFEEDING SERVICE

Occasionally, circumstances may arise that require us to cancel, postpone or change an appointment.

These may include practitioner illness, unexpected emergencies, adverse travel conditions, venue difficulties or other events outside our reasonable control.

Where this occurs, we will aim to contact affected customers as soon as reasonably possible.

Depending on the circumstances, we may offer an alternative appointment, an equivalent service or an appropriate refund.

Where we cancel a paid appointment and cannot provide an agreed suitable alternative, the customer will be entitled to an appropriate refund for the service not provided, subject to applicable law.

We will endeavour to minimise inconvenience wherever reasonably possible.

13. LATENESS AND MISSED APPOINTMENTS

Customers should make reasonable efforts to attend appointments and classes at the agreed time.

If you expect to be late, please contact us as soon as possible.

Where a customer arrives late, the appointment may need to finish at its originally scheduled time if extending it would interfere with subsequent bookings.

If a customer does not attend and has not provided notice, the booking may be treated as a missed appointment.

Any charges or refund restrictions relating to non-attendance must be fair, proportionate and consistent with the terms disclosed before booking.

We recognise that circumstances involving pregnancy, childbirth, infant care and health may occasionally prevent attendance.

Customers are encouraged to contact us if exceptional circumstances arise.

14. HOME VISITS

Home visits are subject to appointment availability, geographical coverage and appropriate arrangements.

Customers are responsible for providing the correct address and any relevant access information.

Where difficulties with access, safety or other circumstances prevent a visit from proceeding, we may need to rearrange the appointment.

Home visits must take place in an environment reasonably suitable for delivering the requested service.

We may decline to enter or remain at a property where there is a genuine risk to personal safety.

Where a home visit cannot proceed, any payment or refund arrangements will be considered fairly and in accordance with applicable law.

Where an additional travel charge applies, this must be disclosed and agreed before the booking is confirmed.

15. TELEPHONE CONSULTATIONS

Telephone consultations are intended to provide breastfeeding-related information, guidance and discussion within the limitations of remote communication.

Customers should make themselves reasonably available at the agreed appointment time.

A suitable telephone number must be provided.

It is the customer's responsibility to communicate relevant concerns as accurately as reasonably possible.

Certain feeding difficulties or health concerns cannot be fully assessed over the telephone.

Where appropriate, we may recommend that the customer arranges a face-to-face clinical assessment or seeks advice from their GP, midwife, health visitor or another relevant healthcare professional.

Telephone consultations are not intended to replace urgent medical assessment.

16. BREASTFEEDING PREPARATION CLASSES

Breastfeeding preparation classes are intended to provide education and practical information about breastfeeding and related subjects.

Course content may include feeding expectations, positioning, attachment, colostrum, expressing milk and managing common breastfeeding challenges.

Class content is based on relevant professional knowledge and guidance available at the time.

Individual experiences of pregnancy, childbirth and breastfeeding vary.

Participation in a class does not guarantee a particular breastfeeding outcome.

Customers should notify us in advance if they have accessibility needs or other reasonable requirements that may affect participation.

We will consider reasonable adjustments in accordance with applicable equality legislation.

17. DROP-IN SESSIONS

Breastfeeding support drop-in sessions may be offered according to published dates, times, locations and availability.

Where attendance is subject to booking or capacity restrictions, these conditions will be communicated appropriately.

Drop-in sessions may involve multiple attendees.

We ask all participants to respect the privacy and dignity of others.

The nature of advice available during a drop-in session may differ from that provided during a full individual consultation.

Where further assessment or additional support is appropriate, we may recommend a separate appointment or referral to another healthcare service.

18. MEDICAL INFORMATION AND PROFESSIONAL ADVICE

Exeter Breastfeeding Service provides breastfeeding-related information, education and support within the practitioner's professional competence and the scope of the service arranged.

The information available on our website is general in nature.

It is not intended to provide an individual diagnosis or replace medical care from an appropriate healthcare professional.

Advice given during a consultation will depend on the information available, the assessment that can reasonably be undertaken and the practitioner's professional judgement.

Customers should inform us about relevant medical conditions, feeding difficulties and other matters that may affect the advice provided.

We will endeavour to provide services with reasonable care and skill.

Nothing in these Terms and Conditions excludes liability arising from a failure to exercise the standard of care required by law.

19. EMERGENCIES AND URGENT MEDICAL CONCERNS

Exeter Breastfeeding Service is not an emergency medical service.

Our website, booking facilities and ordinary communication channels are not intended for urgent medical treatment or emergency assistance.

If you or your baby require immediate medical assistance, contact the appropriate emergency service.

In the United Kingdom, call 999 for a life-threatening emergency.

For urgent medical advice that is not immediately life-threatening, contact NHS 111 or an appropriate healthcare professional.

Customers should not delay seeking urgent clinical assistance while waiting for a response to an email, booking enquiry or routine consultation request.

20. INDIVIDUAL OUTCOMES

Breastfeeding experiences differ significantly between individuals and families.

Factors affecting feeding may include maternal health, infant health, birth circumstances, medical conditions, feeding history and other individual considerations.

Although we aim to provide appropriate information and practical support, we cannot guarantee that a particular technique, intervention or course of guidance will produce a specific outcome.

We do not guarantee that every breastfeeding difficulty can be resolved through our services alone.

Where further investigation or specialist assistance is necessary, we may recommend another appropriate service.

This section does not limit our obligation to provide services with reasonable care and skill.

21. PROFESSIONAL BOUNDARIES AND SCOPE OF SERVICES

The services provided by Exeter Breastfeeding Service are limited to those described and agreed at the time of booking.

A consultation does not automatically establish an ongoing care arrangement or responsibility for monitoring the customer's health or their baby's health outside the agreed service.

Where continuing care, additional appointments or specialist support is necessary, appropriate arrangements should be made.

We may recommend other healthcare professionals where a matter falls outside our service or professional competence.

Customers remain free to seek independent medical advice or additional professional opinions.

22. CONFIDENTIALITY

We recognise that information shared during pregnancy, breastfeeding and postnatal consultations can be highly personal.

We aim to treat information obtained through our services with appropriate confidentiality and respect.

Personal and health-related information will be handled in accordance with our Privacy Policy, applicable data protection requirements and relevant professional obligations.

Confidentiality may be subject to lawful exceptions, including circumstances involving safeguarding concerns, serious risks to life or safety, or other legally permitted or required disclosures.

We will not routinely share identifiable information about customers or their babies for unrelated commercial purposes.

23. PERSONAL INFORMATION AND DATA PROTECTION

We may collect and process personal information necessary to administer bookings, provide services, manage payments and maintain appropriate records.

Certain information may concern pregnancy, breastfeeding, infant feeding and health.

Such information may be classified as special category personal data under UK GDPR.

We will process personal data in accordance with applicable law and the arrangements explained in our Privacy Policy.

Customers should review the Privacy Policy for further information about the purposes of processing, lawful bases, retention, sharing and their rights.

Our Privacy Policy is intended to be read alongside these Terms and Conditions.

24. WEBSITE COOKIES

Our website may use cookies and similar technologies to provide essential functionality, support booking processes, maintain security and operate certain optional website features.

Where required by law, visitors will be given appropriate information and consent choices relating to non-essential technologies.

Further details are provided in our separate Cookie Policy.

These Terms and Conditions do not replace the information or consent requirements applicable to cookies and electronic communications.

25. GIFT CARDS

Where gift cards are offered through our website, they may be purchased for use against eligible services in accordance with the applicable gift card conditions.

The value, validity period, redemption requirements and any restrictions will be communicated during purchase or through the relevant gift card information.

Gift cards may be subject to restrictions relating to the services available for redemption.

Any such restrictions must be fair and clearly communicated before purchase.

Where a service booked using a gift card is cancelled, the applicable refund or credit arrangements will depend on the circumstances and relevant consumer rights.

Gift card terms will not exclude statutory rights that cannot lawfully be restricted.

Customers should contact us if they have questions about redemption, availability or a gift card purchase.

26. WEBSITE ACCOUNTS AND BOOKING ACCESS

Where website membership or customer account functions are available, users are responsible for keeping their login details confidential.

Users should not share passwords or knowingly permit unauthorised access to their accounts.

Customers should notify us if they become aware of a security issue affecting their account.

We may take reasonable steps to restrict access where necessary to protect website security, prevent misuse or comply with legal obligations.

Such action will not remove any statutory right to services, refunds or other remedies that a customer may possess.

27. INTELLECTUAL PROPERTY

Unless otherwise stated, the original written content, educational materials, website text, photographs, graphics and other materials created for Exeter Breastfeeding Service are owned by us or used with appropriate permission.

These materials are protected by applicable intellectual property laws.

Visitors may access and use website information for lawful personal and non-commercial purposes.

Customers must not reproduce, distribute, commercially exploit or represent our original educational materials as their own without appropriate authorisation.

This restriction does not prevent lawful quotation, permitted personal use or other activities protected by law.

Third-party material remains subject to the rights of its respective owners.

28. EDUCATIONAL MATERIALS

Where we provide educational handouts, presentations, written guidance or other resources, these are intended to support learning and understanding.

Materials may be supplied during classes, consultations or follow-up communications.

Unless expressly stated otherwise, such resources are for the customer's personal use.

Customers should not reproduce or redistribute paid or proprietary educational materials for commercial purposes without permission.

Educational materials are not a substitute for individualised medical advice where clinical assessment is necessary.

29. PHOTOGRAPHS, REVIEWS AND TESTIMONIALS

We may invite customers to provide reviews or feedback about their experiences.

Participation is voluntary.

We will not require customers to provide a public review as a condition of receiving services.

Where we wish to publish identifiable photographs, personal stories or testimonials, we will consider the appropriate permission and data protection requirements.

Particular care will be taken with information relating to babies, children, medical circumstances or other sensitive matters.

We will not assume that attending a class or consultation gives automatic permission for identifiable photographs or personal health information to be published.

30. ACCEPTABLE WEBSITE USE

Visitors must use our website lawfully and respectfully.

You must not knowingly interfere with website security, attempt unauthorised access to restricted systems, introduce malicious software or use the website for fraudulent purposes.

Visitors must not misuse forms, booking systems or communication facilities.

We may take reasonable steps to protect our website, customers and service providers against misuse.

Nothing in this section prevents lawful complaints, honest reviews, legitimate consumer disputes or the exercise of statutory rights.

31. THIRD-PARTY LINKS AND SERVICES

Our website may contain links to external organisations, healthcare resources, social media platforms, payment providers or other third-party websites.

These websites operate independently and may have their own terms, privacy policies and practices.

We do not control unrelated external websites and cannot guarantee the accuracy or availability of their content.

Where a third-party service is directly involved in a booking or transaction, its applicable terms may also be relevant.

Customers should review the appropriate information before using external services.

We will not use third-party terms to remove responsibilities imposed on Exeter Breastfeeding Service by law.

32. WEBSITE AVAILABILITY

We aim to maintain a reliable and accessible website.

However, website availability may occasionally be interrupted because of maintenance, technical faults, hosting issues, security concerns or other circumstances.

We cannot guarantee that the website will always be uninterrupted or free from technical problems.

Where an outage affects a booking or payment process, customers should contact us for assistance.

We will take reasonable steps to address identified problems and provide an appropriate remedy where required by law.

33. ACCESSIBILITY AND REASONABLE ADJUSTMENTS

Exeter Breastfeeding Service aims to make its information and services accessible to as many individuals as reasonably possible.

We recognise that some customers may require adjustments because of disability, health conditions, communication requirements or other accessibility needs.

Customers are encouraged to inform us of relevant requirements when arranging a booking.

We will consider reasonable adjustments in accordance with applicable equality legislation.

Where a particular adjustment cannot reasonably be provided, we will endeavour to discuss suitable alternatives.

34. RESPECTFUL CONDUCT

We aim to provide a welcoming, supportive and respectful environment for customers, families and practitioners.

We expect individuals attending classes, consultations or other services to treat others with courtesy and respect.

Harassment, threatening behaviour, discrimination or conduct presenting a genuine safety risk will not be accepted.

Where serious concerns arise, we may take proportionate action, including ending an appointment or declining future bookings where lawful.

Any financial consequences will be considered fairly, including the customer's statutory rights.

35. LIMITATION OF LIABILITY

Exeter Breastfeeding Service will provide its services with reasonable care and skill in accordance with applicable consumer protection legislation.

Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded.

Nothing in these Terms and Conditions removes a customer's statutory rights under the Consumer Rights Act 2015.

We do not guarantee particular breastfeeding outcomes, but this does not reduce our responsibility to deliver services to the standard required by law.

Any limitation of liability will apply only to the extent permitted by applicable legislation and will be interpreted fairly.

36. COMPLAINTS AND CONCERNS

We aim to provide a professional, respectful and supportive service.

If you are dissatisfied with an appointment, class, booking arrangement or another aspect of our service, please contact us.

We encourage customers to explain the nature of their concern and provide relevant booking details where appropriate.

We will aim to consider concerns fairly and respond within a reasonable period.

Where a complaint concerns professional conduct or clinical care, it may be appropriate for the customer to contact a relevant professional or regulatory organisation.

Nothing in these Terms and Conditions prevents customers from seeking independent advice, contacting an appropriate regulator or exercising legal rights.

37. EVENTS OUTSIDE OUR REASONABLE CONTROL

Certain circumstances outside our reasonable control may affect the delivery of services.

These may include severe weather, travel disruption, significant illness, public emergencies, unexpected venue closure or failure of essential third-party systems.

Where such an event affects a booking, we will take reasonable steps to inform customers and minimise disruption.

Depending on the circumstances, we may offer alternative arrangements or an appropriate refund.

This section does not remove consumer remedies that apply where a service cannot be provided.

38. CHANGES TO SERVICES OR TERMS

We may amend our services, website information and Terms and Conditions where reasonably necessary.

Changes may reflect developments in professional guidance, operational arrangements, legislation, available services or website functionality.

Updated Terms and Conditions will be published on our website.

Changes will generally apply to future bookings rather than retrospectively altering agreed contractual terms.

Where a material change to an existing booking is necessary, we will seek to communicate with the affected customer and consider their rights.

39. SEVERABILITY

If any provision of these Terms and Conditions is found to be invalid, unenforceable or unlawful, that provision will be treated as ineffective to the extent required by law.

The remaining provisions will continue to apply where they can lawfully operate independently.

No invalid provision will be interpreted as limiting statutory rights.

40. GOVERNING LAW

These Terms and Conditions are governed by the applicable laws of England and Wales.

Disputes arising in connection with our services will be subject to the jurisdiction of the appropriate courts, taking account of any mandatory consumer protections that apply.

Nothing in this section removes rights relating to applicable consumer law or lawful access to dispute resolution.

41. YOUR STATUTORY RIGHTS

Customers have rights under applicable consumer protection legislation, including the Consumer Rights Act 2015.

Services must be provided with reasonable care and skill.

Where the law provides remedies for services that do not meet the required standard, those remedies remain available.

Nothing in these Terms and Conditions is intended to exclude, reduce or restrict statutory rights.

Where any provision of these Terms and Conditions conflicts with mandatory legal requirements, the law will take precedence.

42. RELATED POLICIES

These Terms and Conditions should be read alongside other relevant information published on our website.

These include:

Privacy Policy

Explains how personal information is collected, used, protected and processed.

Cookie Policy

Explains how cookies and similar technologies are used and how visitors can manage their preferences.

Refund Policy

Explains the arrangements applicable to booking cancellations and refunds, subject to relevant statutory rights.

Where policies overlap, they should be interpreted consistently with applicable law.
